1. Who you are contracting with

These Terms are a binding agreement between you and Kalea Breanna Archer Greene (trading as Plume, "we", "us", "Plume"), the seller and operator of the Plume platform (the "Service"). By creating an account or using the Service you accept these Terms. If you are using the Service on behalf of an organisation, you confirm you have authority to bind it.

2. The Service

Plume is an Intelligent Beauty Commerce platform connecting aesthetic clinics, beauty brands, and beauty lovers. Plans include Plume Pro (for clinics), Plume Brand (for brands), and Plume Beauty Lovers (free consumer accounts).

3. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for unlawful, fraudulent, or deceptive purposes;
• send spam, malware, or infringe intellectual property rights;
• probe, scan, or otherwise interfere with the security or integrity of the Service;
• scrape, reverse engineer, or resell the Service or its content;
• circumvent technical limits or plan entitlements.

4. Accounts

You must provide accurate registration information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account.

5. Intellectual property

Plume and its underlying software, content, and branding are owned by Kalea Breanna Archer Greene and protected by applicable law. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. You retain ownership of content you submit; you grant us a limited licence to host and process it solely to provide the Service.

6. Service level

We work hard to keep Plume available, but we do not guarantee that the Service will be uninterrupted, timely, or error-free. To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.

7. Payments, subscriptions, and our reseller

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, tax, cancellation, and refund mechanics are governed by Paddle's Checkout / Buyer Terms in addition to these Terms.

Plume Pro and Plume Brand are paid subscriptions billed monthly or annually, in advance, and renew automatically until cancelled. Each new clinic or brand starts with a 30-day free trial; you will not be charged until the trial ends. You can cancel at any time and will retain access until the end of the current paid period.

8. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we may delete your data after a reasonable export window unless retention is required by law.

9. Liability

To the maximum extent permitted by law, our aggregate liability for any claim relating to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded by law.

10. Your indemnity

You agree to indemnify Kalea Breanna Archer Greene against third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

11. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be notified by email or in-app notice; continued use after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Kalea Breanna Archer Greene is established, and disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer law provides otherwise.
